Statutory Employment Protection Summary
School District Five of Lexington and Richland Counties is committed to compliance with SC Code of Laws Section 8-27-10, et seq., which states that a public employee cannot be retaliated against or disciplined for reporting in good faith to the appropriate authority allegations of wrongdoing within the employing public body. Wrongdoing is defined in the statute to include actions by the public body which, among other things, result in substantial misuse or loss of substantial public funds or resources, or an allegation that a public employee has intentionally violated federal or State laws. If the public body retaliates against such an employee for making the report, that employee may file a cause of action against the public body for a variety of remedies.
